The Colavita® & Trinity Oaks® Recipe Contest
OFFICIAL CONTEST RULES

1. ELIGIBILITY. No purchase necessary. Contest void where prohibited by state or federal law including California, Utah, and Puerto Rico. You must be at least 21 years old and a legal resident of the U.S. to participate. Employees of Colavita USA, LLC or Trinity Oaks Vineyards/Trinchero Family Estates (the “Sponsors”), and members of such employees’ immediate families, or their agents, their affiliates or subsidiaries, their advertising agencies, licensed alcohol beverage retailers and wholesalers or any other alcohol beverage licensee, and any other company involved with the design, production, execution or distribution of the promotion , are not eligible. Entries not meeting all of the requirements stated herein will be disqualified and ineligible.

2. RULES AND REQUIREMENTS. Each recipe entry must be an original creation of the entrant and belong solely to the entrant and all winners will be required to execute documents confirming this. Recipes that have knowingly been previously published are not eligible. All recipe entries must include Colavita® Extra Virgin Olive Oil, or Colavita® Balsamic Vinegar as ingredients. Recipes may be entered in one of the following categories: green salad or pasta salad. Each recipe must include a list of ingredients in order of use and step-by-step preparation instructions, using common U.S. household measurements, and specify number of servings. A color photograph of the finished product is welcome but not required. (If submitting digital photos, 300 bpi resolution is preferred). If you have a story to tell relating to your creation, please include it.

3. HOW TO ENTER. Entries will be accepted by U.S. mail or Internet E-mail beginning March 1, 2005. Tennessee residents must submit entry by U.S. mail only. Entries submitted by U.S. mail should be typed or neatly handwritten on clean, white 8-1/2” x 11” paper and addressed to Colavita® and Trinity Oaks® Recipe Contest, P.O. Box 9143, Elizabeth, NJ 07202. To enter via E-mail, visit either colavita.com or trinityoaks.com. You may enter as often as you wish using different recipes, but each recipe entry must be submitted separately, with one recipe per envelope or E-mail message, and each entry must comply with all rules. All entries must include: your full name, daytime telephone number and full address, including street address, city, state and zip code. You may also wish to include your E-mail address, if any. All entries must be received by 11:59 pm Eastern Standard Time on June 15, 2005. Contest Sponsors and their agents are not responsible for entries lost or delayed in delivery for any reason, including but not limited to computer malfunctions. Contest Sponsors reserve the right to disqualify illegible, mutilated, altered or illegal entries or entries that do not comply with these rules.

4. JUDGING. Entrants agree to be bound by the decision of the judges, which is final. During the week of June 15, 2005, qualified recipe entries will be first judged with equal emphasis on the following criteria: creativity; appeal to a wide spectrum of American tastes and ease of preparation. Finalists’ recipes so chosen will be judged by food industry professionals in an as yet to be determined location and time.

5. NOTIFICATION OF WINNERS. Winners will be notified by mail within four weeks of final judging. Winners will be required to sign and return within ten (10) business days an Affidavit of Eligibility and Compliance, and Publicity and Liability Release in which the winner will be required to provide information necessary to comply with Internal Revenue Code Form 1099-MISC reporting. Should a winner fail to comply with this requirement, his or her prize will be forfeited, and awarded to an alternate entrant. Any prize that is unclaimed by a winning entrant or alternate by August 31, 2005, will not be awarded. To request a list of winners, send a SASE to: Colavita® and Trinity Oaks® Recipe Contest, P.O. 6. PRIZES. Grand prize (1 winner for best overall recipe): One week cooking course at the Culinary Institute of America in Hyde Park, NY. Trip consists of economy-class round trip air travel from major U.S. airport nearest winner’s residence to Albany, NY, 6 nights’ hotel stay in Hyde Park, 2 meals per day, all ground transportation while in Albany and one (1) week attendance at the CIA Culinary Boot Camp. Approximate Retail Value (“ARV”): $4,000. First Place (2 winners: 1 from each category): one-year supply of Colavita Extra Virgin Olive Oil (12-1 liter tins). ARV: $173.80. Second Place (15 winners) Colavita Gift Basket. ARV: $100 each. Prizes are non-transferable and not redeemable for cash. No substitution of prizes allowed. Total number of winners: 18. Total value of prizes awarded: $5,847.60.

7. RIGHTS TO RECIPES AND OTHER ENTRY MATERIALS AND PUBLICITY. By entering into this contest, entrants will lose all ownership rights to their recipes and submitted materials. By entering this contest, entrants agree to irrevocably assign and transfer, without any additional consideration, to Colavita USA, LLC and Trinity Oaks Vineyards/Trinchero Family Estates, any and all interest in, and in any rights, including but not limited to copyrights, to the use of, all submitted works, including recipes, photos and creation stories. All submitted entry materials, and all rights to use, reproduce, modify, publish and/or distribute recipes, photos and stories submitted, for any purpose including publicity, promotions or marketing, become the exclusive property of the Sponsors and will not be returned. Entrants further agree that should they be chosen as a winner, the Sponsors may publish their names and likenesses in publicity or promotions without further compensation.

8. LIMITATION OF LIABILITY. If for any reason beyond the control of the Sponsors the contest cannot be completed as planned, including but not limited to technical failures, computer viruses, tampering, fraud, or theft, which corrupt the integrity of the conduct and/or judging of this contest, the Sponsors reserve the right in their sole discretion to cancel, terminate, modify or suspend the contest.

Entrants agree to release the Sponsors and their affiliates and agencies, and their officers, directors, members, shareholders, employees and representatives, judges from all liability for any warranty or representation concerning the nature, conditions or value of the prizes, and liability for any injury to any person or property which may occur in connection with the acceptance, use and/or enjoyment of any goods and/or services which constitute a prize awarded under this contest.

Taxes are the sole responsibility of winners. Grand prize winner is responsible for transportation to and from major U.S. airport nearest winner’s residence and for all expenses incurred that exceed the spending allowance.
